On 30 December 2022 the UN General Assembly passed Resolution 77/247 containing a kitchen-sink of allegations against Israel.
The Resolution concluded by asking the International Court of Justice (ICJ) to give an “advisory opinion” on loaded questions referring to “ongoing violation by Israel of the right of the Palestinian people to self-determination”, “prolonged occupation, settlement and annexation of the Palestinian territory”, “measures aimed at altering the demographic composition, character and status of the Holy City of Jerusalem”, and “related discriminatory legislation and measures”.
The drafters of the Resolution no doubt hoped that the ICJ would advise that the West Bank, including East Jerusalem, and the Gaza Strip are illegally occupied by Israel and that Israel must immediately end any presence there and any control over their borders.
The barbaric attacks of 7 October 2023 and the ensuing war have shown that any such advice would be wholly impractical. But will the ICJ give that advice all the same?
Public hearings in the case will open on 19 February 2024.

Natasha Hausdorff is a barrister at 6 Pump Court Chambers and a frequent speaker on International Law. She has a law degree from Oxford University, qualified as a solicitor at Skadden, and subsequently gained an LLM from Tel Aviv University, focussing on public international law and the law of armed conflict.
She clerked for Miriam Naor, President of Israel’s Supreme Court, and was a Fellow at Columbia Law School’s National Security Program. Natasha is legal director of UKLFI Charitable Trust.
In the course of the current conflict, Natasha has been interviewed frequently on television to explain the application of the law of armed conflict. Daniel Berke is a specialist in criminal and fraud law, professional discipline, privacy and regulatory law, based in Manchester.
Daniel has spoken nationally and internationally on various legal issues, including regulation of online hate, international money laundering, anonymity for suspects facing allegations of sexual offences and the application of law to challenge terrorist financing.
Daniel is a Director of UK Lawyers for Israel.
